(E) TERM AND RENEWAL OF PERMITS.

A PERMIT TO OPERATE A LANDFILL REFUSE DISPOSAL SYSTEM
OR SLUDGE COMPOSTING FACILITY SHALL BE VALID FOR A PERIOD OF
3 YEARS FROM THE DATE OF ISSUE, UNLESS SUSPENDED OR REVOKED
BY THE DEPARTMENT. THE PERMIT SHALL BE AUTOMATICALLY
RENEWED UPON WRITTEN APPROVAL OF THE DEPARTMENT. IF THE
DEPARTMENT DOES NOT GRANT WRITTEN RENEWAL APPROVAL PRIOR TO
THE PERMIT'S EXPIRATION BECAUSE OF FAILURE TO COMPLY WITH
THE CONDITIONS OF THE PERMIT, THE PERMITTEE SHALL COMPLY
WITH ALL PROVISIONS REQUIRED BY THE DEPARTMENT WITHIN THE
PRESCRIBED TIME PERIOD, OR FILE A NEW APPLICATION.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 394.

In subsection (e) of this section, the former
reference to "3 years from ... June 1, 1979" is
deleted as obsolete.

The only other changes are in style.

9-211. APPROPRIATION OF FEDERAL FUNDS FOR SEWERAGE SYSTEMS
IN PATUXENT RIVER WATERSHED.

(A)  APPLICABILITY OF SECTION.

THIS SECTION DOES NOT APPLY IF ITS APPLICATION WOULD
CAUSE THE STATE TO LOSE OR BE DENIED ANY FEDERAL ASSISTANCE
OR FUNDS OTHERWISE AVAILABLE.

(B)  REQUIREMENTS.

ALL FEDERAL GRANTS, LOANS, OR OTHER FUNDS AVAILABLE TO

THE DEPARTMENT THAT ARE TO BE SPENT ON SEWERAGE SYSTEMS IN

THE PATUXENT RIVER WATERSHED AREA SHALL BE APPROPRIATED BY
THE DEPARTMENT AS FOLLOWS:

(1) AVAILABLE FUNDS SHALL BE APPROPRIATED FOR
USE IN UPGRADING AND FLOODPROOFING EXISTING SEWERAGE
SYSTEMS, COLLECTOR LINES, OR FACILITIES IN THE AREA TO MEET
STANDARDS CURRENTLY IN EFFECT PURSUANT TO THIS SUBTITLE.
AVAILABLE FUNDS MAY NOT BE APPROPRIATED FOR USE IN
CONSTRUCTING ANY NEW SYSTEMS, COLLECTOR LINES, OR FACILITIES
IN THE AREA IF THE FUNDS COULD BE UTILIZED TO UPGRADE AND
FLOODPROOF ANY EXISTING SYSTEMS, COLLECTOR LINES, OR
FACILITIES IN THE AREA.

(2) NOTWITHSTANDING PARAGRAPH (1) OF THIS
SUBSECTION, AVAILABLE FUNDS MAY BE APPROPRIATED FOR
CONSTRUCTION OF NEW SYSTEMS, COLLECTOR LINES, OR FACILITIES
THAT WILL NOT REQUIRE DISCHARGE INTO A RIVER, INCLUDING ON
LAND DISPOSAL SYSTEMS.
