SUBTITLE 6. SHORT TITLE.

8-601. SHORT TITLE.

THIS TITLE MAY BE CITED AS THE "MARYLAND RADIATION
ACT".

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 688.

"Protection" is deleted for the short title for
consistency with the name of this revised title.

The only other changes are in style.

GENERAL REVISOR'S NOTE:

Former Article 43, § 683, which stated that existing
rights were unimpaired by the enactment of the former
Radiation Control subtitle, is deleted as unnecessary.

Former Article 43, § 684, which contained a general
severability provision, is deleted as unnecessary in light
of Article 1, § 23 of the Code.

Former Article 43, § 685 provided that the powers,
duties, and functions vested in the Secretary under the
former subtitle were not to be construed so as to affect
other powers, duties, and functions vested in the Secretary
under other laws. That section is deleted in light of HG §
2-104, which provides for the general rulemaking authority
of the Secretary.

The definitions in § 8-101 (d) and (f) of this title
are new language added for clarity. Former Article 43, §
689A(a), the precursor to §§ 8-101(d) and (f) and 8-301 of
this title, used the undefined term "general and specific
licensing". In adopting rules and regulations under the
mandate of former § 689A(a), the Secretary followed a plan
used in other "agreement states". An "agreement state" is
one that has entered into an agreement with the federal
government under a provision similar, to § 8-108 of this
title. The Secretary has adopted by reference (COMAR
10.14.02) model regulations published by the Nuclear
Regulatory Commission and other agencies: "Suggested State
Regulations for Control of Radiation, October, 1974" (SSR).
The SSR establishes a 5 tier system of state regulation of
users of ionizing radiation sources. Ranging from least to
most restrictive, the levels are:
