RULES AND REGULATIONS THAT EXEMPT FROM THE LICENSING OR
REGISTRATION REQUIREMENTS OF THIS SECTION:

RADIATION;

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 689A(a) through (d).

"Subject to Subtitle 4 of this title" is new
language added in subsection (a)(1) of this
section to reflect the impact of Ch. 727, Acts of
1981, which added the provisions that appear as
Subtitle 4 of this title.

In subsection (a)(l)(i) of this section,
"material" is added following "byproduct" for
clarity and because the rules and regulations
adopted by the Secretary refer to "byproduct
material", rather than to "byproducts".

In subsection (a)(l)(iii) of this section, the
former term "equipment" is deleted as included in
"device".

8-302.

Subsection (b)(1)(i) of this section is new
language added to clarify that the only kind of
licensee of whom registration may be required is
a holder of a general license. Since, by
definition, a holder of a specific license has
filed an application and has been approved by the
Department, a separate registration process would
be superfluous.

In subsection (b)(2) of this section, "specific"
is substituted for "certain" for clarity.

ENFORCEMENT — IMPOUNDING RADIATION SOURCES.

WHENEVER THE SECRETARY FINDS THAT AN EMERGENCY EXISTS,
THE SECRETARY MAY ORDER THE IMPOUNDMENT. OF ANY SOURCE OF
IONIZING RADIATION THAT IS IN THE POSSESSION OF ANY PERSON:

(1) WHO IS NOT EQUIPPED TO MEET THE REQUIREMENTS
OF THIS SUBTITLE OR THE RULES AND REGULATIONS ADOPTED UNDER
THIS SUBTITLE; OR

(2) WHO VIOLATES THE PROVISIONS OF THIS SUBTITLE
