ON BEHALF OF THIS STATE, THE GOVERNOR MAY MAKE
AGREEMENTS WITH THE FEDERAL GOVERNMENT FOR THE FEDERAL
GOVERNMENT TO DISCONTINUE CERTAIN OF ITS RESPONSIBILITIES
WITH RESPECT TO SOURCES OF RADIATION AND FOR THIS STATE TO
ASSUME THE DISCONTINUED RESPONSIBILITIES.

without substantive change from former Article
43, § 689.

As to the authority of the federal government to
enter into these agreements, see 42 U.S.C.
263m(l).

SUBTITLE 2. RADIATION CONTROL ADVISORY BOARD.

8-201... BOARD ESTABLISHED.

THERE IS A RADIATION CONTROL ADVISORY BOARD IN THE
DEPARTMENT.

REVISOR'S NOTE: This section formerly appeared as the
first sentence of Article 43, § 686(a).

It is set forth as a separate section for
emphasis.

The only other changes are in style.

8-202. MEMBERSHIP.

(A)  COMPOSITION.

(1)  THE BOARD CONSISTS OF 10 MEMBERS APPOINTED
BY THE SECRETARY.

(2)  IN MAKING APPOINTMENTS TO THE BOARD, THE
SECRETARY SHALL CHOOSE MEMBERS OF THE BOARD SO THAT THE
BOARD IS FAIRLY REPRESENTATIVE OF THE BUSINESSES AND
PROFESSIONS THAT ARE INTERESTED IN THE SUBJECT OF RADIATION.

(B)  QUALIFICATIONS.

EACH MEMBER SHALL BE AN INDIVIDUAL WHO IS RECOGNIZED AS
KNOWLEDGEABLE ABOUT THE SUBJECT OF RADIATION.

(C)  TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 4 YEARS AND BEGINS
ON JUNE 1.

(2)  THE TERMS OF MEMBERS ARE STAGGERED AS
REQUIRED BY THE TERMS PROVIDED FOR MEMBERS OF THE BOARD ON
JULY 1, 1982. THE TERMS OF THOSE MEMBERS END AS FOLLOWS:
