reflect the organizational structure of this
article.

(B) BOARD.

"BOARD" MEANS THE RADIATION CONTROL ADVISORY BOARD.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 676(b).

The defined term is shortened from "Advisory
Board" to "Board" for brevity.

.(C) EMERGENCY.

"EMERGENCY" MEANS A SUDDEN AND UNFORESEEN CONDITION OF
SUCH PUBLIC GRAVITY AND URGENCY THAT IT REQUIRES IMMEDIATE
RESPONSE TO PROTECT THE PUBLIC HEALTH AND WELFARE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 676(c) and the first clause of § 680.

The former term "unexpected" is deleted as
included in "unforeseen".

The word "urgency" is substituted for "exigency"
for clarity.

(D)  GENERAL LICENSE.

"GENERAL LICENSE" MEANS A LICENSE THAT, UNDER THE RULES
AND REGULATIONS ADOPTED BY THE DEPARTMENT UNDER THIS TITLE,
IS EFFECTIVE WITHOUT THE FILING OF AN APPLICATION BY THE
LICENSEE.

REVISOR'S NOTE: This subsection is new language derived
in part from the reference to general licensing
in former Article 43, § 689A(a). In addition,
new language is added based on actual practice
and rules and regulations adopted by the
Secretary (COMAR 10.14.02) under the authority of
former Article 43, § 677 — now § 8-106 of this
title. See the General Revisor's Note to this
title.
