7-242. REQUIRED STANDARDS FOR MAINTENANCE OF PERMIT.

(A)  IN GENERAL.

AS A REQUIREMENT FOR KEEPING THE FACILITY PERMIT, EACH
FACILITY PERMIT HOLDER SHALL:

(1)  MAINTAIN A BOND OR OTHER SECURITY THAT THE
DEPARTMENT CONSIDERS SUFFICIENT TO COVER ANY COST FOR:

(I)  GUARANTEEING FULFILLMENT OF ALL
REQUIREMENTS RELATED TO THE FACILITY PERMIT;

(II)  MONITORING, MAINTAINING, OR CLOSING
THE CONTROLLED HAZARDOUS SUBSTANCE FACILITY; AND

(III)  ASSURING THE SECURITY OF THE
CONTROLLED HAZARDOUS SUBSTANCE FACILITY AFTER CLOSING;

(2)  DESIGN, CONSTRUCT, AND OPERATE THE
CONTROLLED HAZARDOUS SUBSTANCE FACILITY IN THE MANNER
APPROVED BY THE DEPARTMENT;

(3)  ESTABLISH EMERGENCY PROCEDURES AND
SAFEGUARDS TO PREVENT ACCIDENTS AND REASONABLY FORESEEABLE
HARM TO HUMAN BEINGS OR THE ENVIRONMENT;

(4)  REPORT PERIODICALLY ON THE CONTROLLED
HAZARDOUS SUBSTANCE THAT IS RECEIVED AND DISCHARGED BY THE
CONTROLLED HAZARDOUS SUBSTANCE FACILITY, INCLUDING, AS
APPLICABLE, VOLUME, AND CHEMICAL, PHYSICAL, BIOLOGICAL, AND
RADIOACTIVE NATURE;

(5)  IN APPROPRIATE CIRCUMSTANCES, ASSIST IN ANY
TRANSFER OF THE OWNERSHIP AND OPERATION OF A CONTROLLED
HAZARDOUS SUBSTANCE FACILITY TO A QUALIFIED AGENCY OF THIS
STATE OR ANY POLITICAL SUBDIVISION OF THIS STATE; AND

(6)  TO THE EXTENT REASONABLY PRACTICABLE,
RESTORE THE CONTROLLED HAZARDOUS SUBSTANCE FACILITY SITE TO
ITS ORIGINAL CONDITION IF USE AS A CONTROLLED HAZARDOUS
SUBSTANCE FACILITY IS TERMINATED.

(B)  ADDITIONAL REQUIREMENTS FOR LOW-LEVEL NUCLEAR
WASTE FACILITY.

IN ADDITION TO THE REQUIREMENTS FOR KEEPING A FACILITY
PERMIT UNDER SUBSECTION (A) OF THIS SECTION, EACH LOW-LEVEL
NUCLEAR WASTE FACILITY PERMIT HOLDER SHALL:
