In paragraph (l)(ii) of this subsection, "human
beings" is substituted for "human health" and
"human systems".

In paragraph (2) of this subsection, the former
reference to "40 CFR Part 116" is deleted as
obsolete. The Environmental Protection Agency
now uses the term "hazardous waste" and
identifies hazardous wastes in 40 CFR Part 261.

The General Assembly may wish to consider
clarifying what is meant by "persists in the
environment" in paragraph (l)(ii) of this
subsection. Literally, many substances may
"persist" without presenting a hazard.

(J) LOW-LEVEL NUCLEAR WASTE.

(1) "LOW-LEVEL NUCLEAR WASTE" MEANS A SUBSTANCE
THAT:

(I)  CONTAINS OR IS CONTAMINATED WITH
RADIOACTIVE MATERIAL EMITTING PRIMARILY BETA OR GAMMA
RADIATION; AND

(II)  IS NEITHER TRANSURANIC WASTE NOR
HIGH-LEVEL NUCLEAR WASTE.

43, § 689B(c) and former NR § 8-1413.2(a)(7).

(K) LOW-LEVEL NUCLEAR WASTE FACILITY.

"LOW-LEVEL NUCLEAR WASTE FACILITY" MEANS A CONTROLLED
HAZARDOUS SUBSTANCE FACILITY FOR LOW-LEVEL NUCLEAR WASTE.

(L) LOW-LEVEL NUCLEAR WASTE FACILITY PERMIT.

"LOW-LEVEL NUCLEAR WASTE FACILITY PERMIT" MEANS A
FACILITY PERMIT ISSUED BY THE DEPARTMENT FOR A LOW-LEVEL
NUCLEAR WASTE FACILITY.

(M) PERSON.

"PERSON" INCLUDES THE FEDERAL GOVERNMENT, THIS STATE,
ANY COUNTY, MUNICIPAL CORPORATION, OR OTHER POLITICAL
SUBDIVISION OF THIS STATE, AND ANY OF THEIR UNITS.
