4-214. AMENDMENTS TO VITAL RECORDS.

(A)  WHEN PERMITTED.

A CERTIFICATE OR RECORD REGISTERED UNDER THIS SUBTITLE
MAY BE AMENDED ONLY IN ACCORDANCE WITH THIS SUBTITLE AND ANY
RULES AND REGULATIONS THAT THE SECRETARY ADOPTS TO PROTECT
THE INTEGRITY AND ACCURACY OF VITAL RECORDS.

(B)  CERTIFICATION TO SECRETARY.

IF ANY CERTIFICATE OF BIRTH, DEATH, OR FETAL DEATH IS
AMENDED, THE FACTS SHALL BE CERTIFIED TO THE SECRETARY AND
ENTERED IN RED INK, WITH THE DATE OF THE AMENDMENT, OVER THE
SIGNATURE OR INITIALS OF A DESIGNEE OF THE SECRETARY.

(C)  COURT ORDER OF NAME CHANGE.

ON RECEIPT OF A COURT ORDER THAT CHANGES THE NAME OF AN
INDIVIDUAL WHO WAS BORN IN THIS STATE AND ON REQUEST OF THE
INDIVIDUAL OR A PARENT, GUARDIAN, OR LEGAL REPRESENTATIVE OF
THE INDIVIDUAL, THE SECRETARY SHALL AMEND THE CERTIFICATE OF
BIRTH TO REFLECT THE NEW NAME.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 19(a).

In subsection (b) of this section, the reference
to "fetal death" is added for clarity. This
addition is based on former references to "death
certificates" that clearly included "fetal
death". Throughout this subtitle, specific
references to "fetal death" are added where
appropriate. See, e.g. § 4-205 of this subtitle;
c.f. § 4-212 of this subtitle.

In subsection (b) of this section, the word
"amended" is substituted for "alteration", for
conformity to subsection (a) of this section and
for clarity.

Also in subsection (b) of this section, the
reference to a "designee" is substituted for "an
authorized representative", to conform to similar
references elsewhere in this article.

The only other changes are in style.
