SUBTITLE 3. CHILD RESISTANT PACKAGING OF DANGEROUS
HOUSEHOLD SUBSTANCES.

5-301. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection formerly appeared as
the first sentence of former Article 43, § 888.

(B)  CHILD RESISTANT PACKAGING.

"CHILD RESISTANT PACKAGING" MEANS PACKAGING THAT IS
DESIGNED SO THAT THE AVERAGE CHILD UNDER THE AGE OF 5 YEARS
FINDS IT SIGNIFICANTLY DIFFICULT TO OPEN THE PACKAGE OR TO
OBTAIN A HARMFUL AMOUNT OF THE CONTENTS OF THE PACKAGE
WITHIN A REASONABLE TIME, AND SO THAT IT IS NOT DIFFICULT
FOR A NORMAL ADULT TO OPEN OR USE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 888(3).

In this subsection, "child resistant packaging"
is substituted for "special packaging" to reflect
current terminology, which is more appropriately
descriptive of this law.

In this subsection, the former words "or
constructed" are deleted as included in
"designed".

Also in this subsection, the former provision
that special packaging need not be difficult for
all children to open is deleted as unnecessary.

(C)  HOUSEHOLD SUBSTANCE.

"HOUSEHOLD SUBSTANCE" MEANS ANY SUBSTANCE THAT IS
CUSTOMARILY USED OR STORED BY INDIVIDUALS IN OR ABOUT THE
HOUSEHOLD AND THAT IS:

(1) A HAZARDOUS SUBSTANCE AS DEFINED IN THE
FEDERAL HAZARDOUS SUBSTANCES ACT;
