HARRY HUGHES, Governor

2007

reference to "appeal therefrom to any court
having equity jurisdiction" is deleted as
included in "for judicial review of final
decisions in the Administrative Procedure Act".
The Administrative Procedure Act requires appeals
from agency decisions to be brought in a Circuit
Court, see Article 41, § 255 of the Code. Since
an administrative law case is outside the equity
jurisdiction of the District Court, see CJ §§
4-401 and 4-402(a), the references to a Circuit
Court in the Administrative Procedure Act are
exhaustive and the language "any court having
equity jurisdiction" is unnecessary and obsolete.
