4-618. ABATEMENT ORDERS.

(A)  IN GENERAL.

IF THE SECRETARY BELIEVES THAT A PERSON IS VIOLATING
ANY PROVISION OF THIS SUBTITLE OR A RULE OR REGULATION
ADOPTED UNDER THIS SUBTITLE, THE SECRETARY SHALL SERVE THE
PERSON WITH A WRITTEN ORDER THAT DIRECTS THE PERSON SERVED
TO ABATE THE VIOLATION WITHIN A TIME SET IN THE ORDER.

(B)  RIGHT TO HEARING AND COUNSEL.

THE SECRETARY SHALL GIVE ANY PERSON SERVED WITH AN
ORDER UNDER THIS SECTION AN OPPORTUNITY FOR A HEARING BEFORE
THE SECRETARY. THE PERSON SERVED MAY BE REPRESENTED AT THE
HEARING BY COUNSEL.

(C)  ACTION AFTER HEARING.

AFTER A HEARING UNDER THIS SECTION, THE SECRETARY MAY
AFFIRM, MODIFY, OR WITHDRAW THE ORDER.

(D)  PROHIBITION.

AFTER THE TIME SET IN THE ORDER FOR ABATING THE
VIOLATION, A PERSON WHO IS SERVED WITH AN ORDER UNDER THIS
SECTION MAY NOT VIOLATE THAT ORDER.

REVISOR'S NOTE: Subsections (a), (b), and (d) of this
section are new language derived without
substantive change from former Article 43, § 201.

Subsection (c) of this section is new language
added to state expressly that which formerly, was
only implied in the law.

The former reference to violations of subsection
(d) of this section being tried in the District
Court is deleted as unnecessary in light of
other, independent provisions of law.

4-619. COMPLIANCE WITH CERTAIN SUBTITLES REQUIRED.

EACH LICENSEE SHALL COMPLY WITH THE REQUIREMENTS OF
THIS SUBTITLE AND SUBTITLE 1 OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the introductory
language to former Article 43, § 200(g) through
(p).
