(A)  IN GENERAL.

UNLESS THE SECRETARY GRANTS AN EXTENSION UNDER THIS
SECTION, A PERSON MAY NOT KEEP ANY FOOD IN, OR PERMIT ANY
FOOD TO REMAIN IN, COLD STORAGE IF THE FOOD HAS BEEN IN COLD
STORAGE FOR MORE THAN 12 MONTHS.

(B)  FIRST EXTENSION.

(1)  A PERSON MAY APPLY TO THE SECRETARY FOR A
FIRST EXTENSION OF THE MAXIMUM COLD STORAGE TIME IN
ACCORDANCE WITH THIS SUBSECTION.

(2)  A PERSON WHO DESIRES A FIRST EXTENSION SHALL
APPLY TO THE SECRETARY DURING THE 12TH MONTH THAT THE FOOD
IS IN COLD STORAGE.

(3)  THE SECRETARY:

(I)  SHALL INSPECT THE FOOD FOR WHICH A
FIRST EXTENSION IS REQUESTED; AND

(II)  IF THE SECRETARY FINDS THAT THE FOOD
IS IN PROPER CONDITION FOR FURTHER COLD STORAGE, SHALL ISSUE
AN ORDER THAT EXTENDS, FOR A SPECIFIED PERIOD NOT TO EXCEED
60 DAYS, THE TIME DURING WHICH THE FOOD MAY BE KEPT IN COLD
STORAGE.

(C)  SECOND EXTENSION.

(1)  A PERSON WHO IS KEEPING FOOD IN COLD STORAGE
UNDER A FIRST EXTENSION MAY APPLY TO THE SECRETARY FOR A
SECOND EXTENSION.

(2)  THE SECRETARY:

(I)  SHALL REINSPECT THE FOOD FOR WHICH THE
SECOND EXTENSION IS REQUESTED; AND

(II)  IF THE SECRETARY FINDS THAT THE FOOD
IS IN PROPER CONDITION FOR FURTHER COLD STORAGE, MAY ISSUE
AN ORDER THAT EXTENDS, FOR AN ADDITIONAL SPECIFIED PERIOD
NOT TO EXCEED 60 DAYS, THE TIME DURING WHICH THE FOOD MAY BE
KEPT IN COLD STORAGE.

(D)  RECORD AND REPORT OF EXTENSIONS GRANTED.
THE SECRETARY SHALL:

(1)  KEEP A RECORD OF EACH. EXTENSION GRANTED
UNDER THIS SECTION, INCLUDING THE KINDS AND QUANTITIES OF
FOOD INVOLVED, THE LENGTH OF THE EXTENSION, AND THE REASON
FOR GRANTING THE EXTENSION;

(2)  KEEP THE RECORD' OPEN FOR PUBLIC INSPECTION
