1954                                  LAWS OF MARYLAND                                Ch. 240

REINSTATEMENT OF A PERMIT.

(E) REPORTS.

EACH CERTIFIED INDUSTRY DAIRY FARM INSPECTOR SHALL SEND
TO THE SECRETARY A REPORT OF EACH INSPECTION THAT THE
CERTIFIED INDUSTRY DAIRY FARM INSPECTOR MAKES.

REVISOR'S NOTE: This section is new language derived
without substantive change from the fourth
paragraph of former Article 43, § 575.

4-415. ISSUANCE OF PERMIT.

(A)  ISSUANCE.

THE SECRETARY SHALL ISSUE THE APPROPRIATE PERMIT TO ANY
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE AND
THE RULES AND REGULATIONS ADOPTED UNDER THIS SUBTITLE FOR
THAT PERMIT.

(B)  SEPARATE PERMITS BY LOCATION.

A SEPARATE PERMIT SHALL BE ISSUED FOR EACH PLACE OF
OPERATION THAT MEETS THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first and
fourth clauses of the first sentence of the
second paragraph of former Article 43, § 575.

In this section, "place of operation" is
substituted for "property" to clarify that
separate permits are required for activities
conducted from a fixed location while only a
single permit is required for those permit
holders -- bobtailers, milk truck tank operators,
and certified industry dairy farm inspectors --
who by definition conduct their activities either
from a vehicle or in many locations.

4-416. SCOPE OF PERMITS.

(A)  BOBTAILER PERMIT.

WHILE IT IS EFFECTIVE, A BOBTAILER PERMIT AUTHORIZES
THE HOLDER, ON A MILK ROUTE THAT THE HOLDER OPERATES OR
CONTROLS, TO DISTRIBUTE PASTEURIZED MILK PRODUCTS THAT THE
HOLDER PURCHASED FROM A DISTRIBUTOR OR A MILK PROCESSOR.

(B)  CERTIFIED INDUSTRY DAIRY FARM INSPECTOR PERMIT.

WHILE IT IS EFFECTIVE, A CERTIFIED INDUSTRY DAIRY
FARM INSPECTOR PERMIT AUTHORIZES THE HOLDER TO INSPECT DAIRY
FARMS IN ACCORDANCE WITH THIS SUBTITLE.
