SUBTITLE 1. CONFIDENTIAL RESEARCH RECORDS.

4-101. "CONFIDENTIAL RECORD" DEFINED.

IN THIS SUBTITLE, "CONFIDENTIAL RECORD" MEANS ANY
RECORD, REPORT, STATEMENT, NOTE, OR OTHER INFORMATION THAT:

STUDY BY:

OR

(1) IS ASSEMBLED OR OBTAINED FOR RESEARCH OR

(I)  THE DRUG ABUSE ADMINISTRATION;

(II)  THE JUVENILE SERVICES ADMINISTRATION;

(III) THE SECRETARY; AND

(2) NAMES OR OTHERWISE IDENTIFIES ANY PERSON.

REVISOR'S NOTE: This section is new language that
combines, without substantive change, the first
and second clauses each of former Articles 43, §
l-I(a), 43B, § 22(a), and 52A, § 8(b). It is
rephrased as a definition for brevity.

In item (l)(i) of this section, reference to the
Drug Abuse Administration is substituted for the
obsolete reference to the Drug Abuse Authority.

In item (l)(ii) of this section, reference to the
Juvenile Services Administration is substituted
for the obsolete reference to the Department of
Juvenile Services.

In item (l)(iii) of this section, reference to
the Secretary of Health and Mental Hygiene is
substituted for the reference to the former
"State Board of Health and Mental Hygiene", in
accordance with former Article 43, § 1H.
