standards referred to in this section from the
noise standards referred to elsewhere in this
title.

In subsection (a)(3) of this section, the defined
term "sound level limit" is substituted for the
term "noise level limits". There does not appear
to be any legislative intent to distinguish the
limits referred to in this section from the
limits referred to elsewhere in this title.

As to the power of other State agencies to adopt
sound level limits and noise control rules and
regulations and the Department's role in
coordinating those efforts, see also Article 41,
§ 14B, NR §§ 5-209 and 8-704, and TR §§ 5-801
through 5-823, 22-601, and 22-605.

The balance of the first sentence of former
Article 43, § 824 now appears in § 3-401 of this
title.

3-104. AUTHORITY TO OBTAIN FUNDS.

THE DEPARTMENT MAY OBTAIN ANY FEDERAL OR OTHER FUNDS
THAT ARE AVAILABLE TO THIS STATE FOR PURPOSES THAT ARE
WITHIN THE SCOPE OF THIS TITLE.

43, § 831.

3-105. POWERS AND DUTIES OF POLITICAL SUBDIVISIONS.

(A)  POWER TO ADOPT ORDINANCES, RULES, OR REGULATIONS.

(1)  EXCEPT AS PROVIDED IN THIS SECTION, THIS
TITLE DOES NOT LIMIT THE POWER OF A POLITICAL SUBDIVISION TO
ADOPT NOISE CONTROL ORDINANCES, RULES, OR REGULATIONS.

(2)  A POLITICAL SUBDIVISION MAY NOT ADOPT ANY
NOISE CONTROL ORDINANCE, RULE, OR REGULATION THAT IS LESS
STRINGENT THAN THE ENVIRONMENTAL NOISE STANDARDS, SOUND
LEVEL LIMITS, AND NOISE CONTROL RULES AND REGULATIONS
ADOPTED UNDER THIS TITLE.

(B)  DUTIES.

EACH POLITICAL SUBDIVISION SHALL:

(.1) SEND TO THE DEPARTMENT A COPY OF EACH NOISE
CONTROL ORDINANCE, RULE, OR REGULATION THAT IT ADOPTS; AND

(2) IDENTIFY ON EACH ZONING MAP, COMPREHENSIVE
PLAN, OR OTHER APPROPRIATE DOCUMENT THE SOUND LEVEL LIMITS
THAT ARE ADOPTED UNDER SUBTITLE 4 OF THIS TITLE.
