IF A HEALTH OFFICER OR DEPUTY OF A HEALTH OFFICER IS A
PHYSICIAN, THE HEALTH OFFICER OR DEPUTY MAY NOT:

(1)  PRACTICE MEDICINE, EXCEPT IN THE PERFORMANCE
OF ANY OFFICIAL DUTIES; OR

(2)  ENGAGE IN ANY OCCUPATION THAT CONFLICTS WITH
THE PERFORMANCE OF ANY OFFICIAL DUTIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 51C.

The former reference to the performance of
official duties "when licensed as a physician in
this State" is deleted as unnecessary in light of
the use of the defined term "physician".

3-304. COMPENSATION; UNCLASSIFIED STATE EMPLOYEE.

(A)  COMPENSATION AND REIMBURSEMENT FOR EXPENSES.
THE HEALTH OFFICER FOR A COUNTY IS ENTITLED TO:

(1)  THE SALARY PROVIDED IN THE STATE BUDGET;

(2)  REIMBURSEMENT FOR EXPENSES UNDER THE
STANDARD STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE
BUDGET; AND

(3)  ANY ADDITIONAL SALARY THAT THE COUNTY
PROVIDES.

(B)  UNCLASSIFIED STATE EMPLOYEE.

EACH HEALTH OFFICER IS AN UNCLASSIFIED STATE EMPLOYEE.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 51A(e) and (f).

The only changes are in style.

As to subsection (a)(2) of this section, Standard
State Travel Regulations are adopted by the
Department of Personnel with the approval of the
Board of Public Works.
