Department may modify the number and composition
of these areas without action by the General
Assembly, any specific enumeration of these areas
is prone to be inaccurate. For a specific
delineation of these areas, see COMAR
10.18.01.03.

Former Article 43, § 693(b)(5), which referred to
the repeal of previous inconsistent ambient air
quality standards, is deleted as unnecessary in
light of the requirement of subsection (c)(1) of
this section that State and federal ambient air
quality standards be identical.

Former Article 43, § 693(b)(8), which referred to
the repeal of previous inconsistent emission
standards by July 1, 1979, is deleted as
obsolete.

2-303. SAME — PROCEDURES FOR ADOPTION.

(A)  COMPLIANCE WITH ADMINISTRATIVE PROCEDURE ACT.

THE DEPARTMENT MAY NOT ADOPT ANY RULE OR REGULATION
UNDER THIS TITLE UNLESS THE REQUIREMENTS OF THIS SECTION AND
THE ADMINISTRATIVE PROCEDURE ACT ARE MET.

(B)  PUBLIC HEARING.

BEFORE ADOPTING ANY RULE OR REGULATION UNDER THIS
TITLE, THE DEPARTMENT SHALL ANNOUNCE AND HOLD A PUBLIC
HEARING ON THE SUBJECT.

(C)  NOTICE.

(1)  AT LEAST 30 DAYS BEFORE THE PUBLIC HEARING,
THE DEPARTMENT SHALL PUBLISH NOTICE OF THE HEARING IN A
NEWSPAPER OF GENERAL CIRCULATION IN THE AREA CONCERNED.

(2)  THE NOTICE SHALL STATE:

(I)  THE DATE, TIME, AND PLACE OF THE
HEARING; AND

(II)  THE PURPOSE OF THE HEARING.

(D)  ACTION AFTER HEARING.

AFTER THE PUBLIC HEARING, THE DEPARTMENT MAY ADOPT THE
RULE OR REGULATION WITH OR WITHOUT MODIFICATION.

(E)  EFFECTIVE DATE OF RULES AND REGULATIONS.

A RULE OR REGULATION ADOPTED UNDER THIS TITLE IS
EFFECTIVE NO EARLIER THAN 60 DAYS AFTER ADOPTION.
