TITLE 3. COUNTY BOARDS OF HEALTH; HEALTH OFFICERS.

SUBTITLE 1. DEFINITIONS.

3-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS TITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language used as
the standard introductory language to a
definition section.

(B)  COUNTY.

"COUNTY" DOES NOT INCLUDE BALTIMORE CITY.

REVISOR'S NOTE: This subsection is new language
patterned after Article 43, § 51(a) and (b). It
is necessary in light of the inclusion in this
article of provisions to which Article 43, §
51(b) would apply and the Title 1 definition of
"county", which otherwise would include Baltimore
City.

In this subsection, the limitation "in {Article
43,} §§ 51 through 51E" -- i.e., those
provisions in Subtitle 3 of this title -- is
omitted. It was unclear whether the provisions
in Subtitle 2 of this title were intended to
apply to Baltimore City. This revision reflects
that Subtitle 2 does not apply to Baltimore City.
In practice, the Baltimore City Council and Mayor
do not act as a "board of health" under former
Article 43, § 45. The office of the Commissioner
of Health indicates that these powers can be
exercised under the broad charter of Baltimore
City.

(C)  HEALTH OFFICER.

"HEALTH OFFICER" DOES NOT INCLUDE THE BALTIMORE CITY
COMMISSIONER OF HEALTH.

REVISOR'S NOTE: This subsection is new language
necessitated by the definition of "health
officer" in Title 1 of this article, which
otherwise would extend this title to the
Baltimore City Commissioner of Health.
