AN ACT concerning

Allegany County - Rates for Water

FOR the purpose of repealing certain provisions that exclude
Allegany County from the authority of the Public
Service Commission, on application, to fix or alter
rates for water service within certain areas.

BY repealing and reenacting, with amendments,

Article 78 - Public Service Commission Law

Section 55

Annotated Code of Maryland

(1980 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 78 - Public Service Commission Law

55.

(a)  Upon written application of any county, sanitary
district, or municipal corporation of this State, the
Commission shall fix or alter the rates (and only the rates)
for water supplied within the boundaries of the applicant by
any other county or municipal corporation, as if the
supplying subdivision were a water company. [This section
shall not apply to Allegany County.] Nothing herein shall be
construed to affect §§ 345 and 347 of the Code of Public
Local Laws of Baltimore County (1948 Edition).

(b)  Upon written application by any municipal
corporation that is located in Talbot County and that
supplies water to an area outside of its corporate
boundaries, the Commission may grant the municipal
corporation a certificate of authority to establish a
service area outside of its corporate boundaries and to
supply that area with water.
