shall be from labor, one member shall be from management and
one member shall be from the public sector. Vacancies, as
they occur from time to time, shall be filled by appointment
by the Governor.
(c) The Board shall supervise, operate and administer
the Subsequent Injury Fund, the Uninsured Employers' Fund
and other funds created, from time to time, under this
article, except the State Accident Fund.
(d) Each member of the Board shall receive such per
diem compensation for each day actually worked as provided
in the State budget. Each member shall also be reimbursed
for actual necessary traveling and incidental expenses as
provided in the State budget. Funds for compensation and
expenses of the Board shall be provided in the
appropriations to the Workmen's Compensation Commission and
shall be deemed to be an appropriation for the expenses of
the Commission for purposes of the special tax provided for
in § 17 of this article.
(e) The Board shall make a report to the Governor
annually, within 90 days after the close of the State's
fiscal year. The report shall include a detailed statement
of the expenses and of the condition of the funds under its
jurisdiction.]

(a) Notwithstanding any other provision of this
article, when a claim for compensation is filed by an
employee, or in case of death, by his dependents, and the
employer has failed (1) to secure the payment of
compensation in accordance with § 16 of this article, (2) to
make deposit of security in accordance with § 16 of this
article and (3) to make payment of compensation according to
the terms of any award within thirty days thereafter, then,
unless an application for review has been timely made or a
notice of appeal has been timely served in the interim, the
award shall be payable out of the fund created under this
subtitle in the manner and subject to the conditions
hereinafter set forth.
[(b) The Commission promptly after the elapse of the
thirty-day period shall notify the fund in writing of the
employer's default in making payment of the award. The
fund, within thirty days after the date of such notice,
shall notify the Commission, in writing, whether it objects
to the findings and decision on which the award is based,
the award made, or the liability of the fund for payment
thereof. If the fund notifies the Commission that it
neither objects to said findings, decision, award, or the
fund's liability therefor, payment of the award shall be
promptly made from the fund in accordance with the terms
thereof and the provisions of § 92 of this article. In the
