2-104. GENERAL AUTHORITY AND DUTIES OF SECRETARY.

(A)  BUDGETS.

THE SECRETARY IS RESPONSIBLE FOR THE BUDGET OF THE
OFFICE OF THE SECRETARY AND FOR THE BUDGET OF EACH UNIT IN
THE DEPARTMENT.

REVISOR'S NOTE: This subsection formerly appeared as
Article 41, § 206(g).

The only changes are in style.

to § 2-103(d) of this subtitle.

(B)  RULES AND REGULATIONS.

(1)  THE SECRETARY MAY ADOPT RULES AND
REGULATIONS TO CARRY OUT THE PROVISIONS OF LAW THAT ARE
WITHIN THE JURISDICTION OF THE SECRETARY.

(2)  THE SECRETARY SHALL REVIEW AND MAY REVISE
THE RULES AND REGULATIONS OF:

(I)  THE BOARD OF REVIEW OF THE DEPARTMENT;

(II)  EACH UNIT IN THE DEPARTMENT THAT IS
AUTHORIZED BY LAW TO ADOPT RULES AND REGULATIONS; AND

(III)  THE DEPARTMENT.

without substantive change from former Article
41, § 206(k).

In this subsection and throughout this article,
for consistency and to avoid unnecessary
confusion, the singular verb "adopt" is used in
relation to rules and regulations and verbs such
as "prescribe" and "promulgate" are deleted.
