"DEPARTMENT" MEANS THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE.

of Health and Mental Hygiene".

(D)  HEALTH OFFICER.

"HEALTH OFFICER" MEANS THE BALTIMORE CITY COMMISSIONER
OF HEALTH OR THE HEALTH OFFICER OF A COUNTY.

REVISOR'S NOTE: This subsection is new language added
to avoid repetition of phrases such as "the
health officer or, in Baltimore City, the
Baltimore City Commissioner of Health" and to
clarify the scope of this article.

Some of the former provisions now revised in this
article expressly stated that a reference to a
"health officer" included the Baltimore City
Commissioner of Health or otherwise clearly
applied to that Commissioner; see, e.g., former
Article 43, §§ 31A(a)(2), 97, and 615(c-l).
However, other former provisions now revised in
this article contained ambiguous references to a
"health officer", "health authority", or "health
commissioner". Throughout this article, the term
"health officer", as defined in this subsection,
is substituted for those former references unless
the former provision expressly did not apply to
Baltimore City. See the General Revisor's Note
to Title 18 of this article; but c.f., § 3-101 of
this article.

(E)  INCLUDES; INCLUDING.

"INCLUDES" OR "INCLUDING" MEANS INCLUDES OR INCLUDING
BY WAY OF ILLUSTRATION AND NOT BY WAY OF LIMITATION.

REVISOR'S NOTE: This subsection is new language added
to state expressly that the words "includes" or
"including" are used in this article by way of
illustration or expansion and not by way of
limitation or restriction.

In light of this definition, phrases such as "but
not limited to" are deleted throughout this
article as superfluous.

The Commission to Revise the Annotated Code
emphasizes, however, that the absence of a like
definition in a previously revised article of the
Code does not mean that "includes" or "including"
is used there in any different sense or that a
