WHEREAS, The present cost threshold of $25,000 over
which the General Professional Services Selection Board
shall have jurisdiction was established in 1974; and
WHEREAS, The rate of inflation since 1974 has risen by
85 percent; and
WHEREAS, Chapter 411 of the Acts of the General
Assembly of Maryland of 1981 raised for the Department of
Transportation its cost threshold of $25,000 to $50,000 over
which the Transportation Professional Services Selection
Board shall have jurisdiction; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article 21 - Procurement
9-207.
(a) A using authority that desires to procure
architectural or engineering services costing over [$25,000]
$50,000 shall present the request to the General Selection
Board at a public meeting.
9-209.
(a) (1) The recommendation of the General Selection
Board for the procurement and award of each contract for
architectural and engineering services costing over
[$25,000] $50,000 shall:
(i) Be made on a competitive basis; and
(ii) Include an evaluation of technical
and price proposals from two or more persons.
(2) Neither the technical proposal nor the price
proposal may be the sole criterion in making a
recommendation on a competitive basis.
9-211.
(a) A person may not be awarded under this subtitle
any contract costing over [$25,000] $50,000 unless the
person has executed a truth-in-negotiation certificate
stating that wage rates and other factual unit costs
supporting the compensation are accurate, complete, and
current as of the time of contracting.
9-215.
(a) (1) The rates of architects and engineers
performing services for a using authority are subject to
post audit.
