(a) (1) It is unlawful for any minor in St. Mary's
County to attempt to purchase alcoholic beverages, or to
drink, or have in his possession, any alcoholic beverages,
in any public place or on any public highway. [The word
"minor" shall apply to every person under 21 years of age,
except bona] BONA fide employees in their course of
employment and whose employment is not prohibited by this
article, and all persons [18 years of age or older shall be
allowed] DESIGNATED UNDER § 2(T)(2) OF THIS ARTICLE HAVE all
the rights of a consumer in regard to beer or light wines.
(2) Any person violating the provisions of this
subsection [shall be] IS guilty of a misdemeanor and, upon
conviction, shall be [subject to a fine] FINED not
[exceeding] MORE THAN $50 for each and every [such]
violation.
(b) (1) It is unlawful for any person to request or
induce a person under 21 years of age to purchase, or to
attempt to purchase, any alcoholic beverages, except beer
and light wine. It is unlawful for any person to request or
induce a person [under 18 years of age] NOT DESIGNATED UNDER
§ 2(T)(2) OF THIS ARTICLE to purchase or attempt to purchase
beer or light wine.
(2) Any person violating the provisions of this
subsection is guilty of a misdemeanor[,] and, upon
conviction [thereof], shall be fined not more than [five
hundred dollars ($500.00)] $500 for each and every
violation.
183.
In Washington County, any person under [twenty-one] 21
years who purchases, procures, or consumes any alcoholic
beverage on any licensed premises, or misrepresents his or
her age for the purpose of purchasing, procuring, or
consuming upon any licensed premises any alcoholic beverages
except beer and light wine; and any person [under the age of
18 years] NOT DESIGNATED UNDER § 2(T)(2) OF THIS ARTICLE who
purchases, procures, or consumes beer or light wine on any
licensed premises, or misrepresents his or her age for the
purpose of purchasing, procuring, or consuming upon any
licensed premises beer or light wine is guilty of a
misdemeanor and shall be punished[,] upon conviction by a
fine not to exceed [fifty dollars ($50.00)] $50.
Jurisdiction over those [minors] PERSONS who are above the
age of juvenile court jurisdiction is in the District Court.
Jurisdiction over those minors who are within the age of
juvenile court jurisdiction is in the juvenile court.
However, if there is a waiver of juvenile jurisdiction with
respect to a minor who is otherwise subject to juvenile
court jurisdiction, then the District Court has jurisdiction
over the matter notwithstanding any provision of § 4-301 of
the Courts Article of the Code to the contrary.
