19-706. REGULATION; APPLICABILITY OF OTHER LAWS.

(A)  REGULATION.

EACH HEALTH MAINTENANCE ORGANIZATION THAT IS ISSUED A
CERTIFICATE OF AUTHORITY BY THE COMMISSIONER SHALL BE
REGULATED UNDER THIS SUBTITLE.

(B)  NONPROFIT HEALTH SERVICE AND OTHER PLANS.

(1)  ANY' HEALTH MAINTENANCE ORGANIZATION THAT IS
REGULATED BY ARTICLE 48A, SUBTITLE 20, NONPROFIT HEALTH
SERVICE PLANS, OF THE CODE IS SUBJECT ALSO TO THIS SUBTITLE.

(2)  THIS SUBSECTION APPLIES TO A CORPORATION
DESCRIBED IN ARTICLE 48A, SUBTITLE 20, NONPROFIT HEALTH
SERVICE PLANS, OF THE CODE, BUT ONLY IF IT IS A HEALTH
MAINTENANCE ORGANIZATION.

(C)   INAPPLICABILITY OF CERTAIN INSURANCE LAWS.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, A HEALTH
MAINTENANCE ORGANIZATION IS NOT SUBJECT TO THE INSURANCE
LAWS OF THIS STATE.

REVISOR'S NOTE: This subsection formerly appeared as
the second sentence of Article 43, § 847(a).

The former erroneous reference to "§ 884(e)"
should have been to former Article 43, § 844(e),
which, in part, now appears in § 19-733 of this
subtitle and provides for an appeal from a
decision of the Commissioner.
