INDIVIDUALS.

PART -I. COMPREHENSIVE PLAN.

19-601. PLAN FOR DAY AND RESIDENTIAL SERVICES.

(A)  PLAN REQUIRED.
THE SECRETARY SHALL:

(1)  DEFINE, FOR PURPOSES OF THIS SECTION,
NONRETARDED DEVELOPMENTAL DISABILITY; AMD

(2)  PREPARE AND CARRY OUT A COMPREHENSIVE PLAN
OF DAY PROGRAMS AND RESIDENTIAL SERVICES FOR INDIVIDUALS
WITH A NONRETARDED DEVELOPMENTAL DISABILITY.

(B)   OTHER CARE NOT AFFECTED.

THIS SECTION DOES MOT PREVENT AN INDIVIDUAL WITH A
NONRETARDED DEVELOPMENTAL DISABILITY FROM BEING ELIGIBLE
FOR:

(1)  FOSTER CARE;

(2)  HELP IN OBTAINING FOSTER CARE; OR

(3)  ANY OTHER SERVICES THAT THE STATE SOCIAL
SERVICES ADMINISTRATION OR A LOCAL DEPARTMENT OF SOCIAL
SERVICES PROVIDES.

REVISOR'S NOTE: Subsection (a) of this section formerly
appeared as the first clause of Article 59A, §
37.

Subsection (b) of this section formerly appeared

as Article 59A, § 4(b), as that subsection

related to nonretarded developmentally disabled

individuals.

The only other changes are in style.

The second clause of former Article 59A, § 37,
which required the plan to be in operation by
July 1, 1974, is deleted as obsolete.

The provision of former Article 59A, § 4(b) that
related to mentally retarded individuals now
appears in § 7-103 of this article.
