Pensions - Disability Retirement
FOR the purpose of establishing for disability eligibility
purposes the enrollment date in the Retirement System
from which the member transferred; providing that a
member who transferred transfers within a certain
period of the filing of the disability application
shall receive the benefits under the system from which
the member transferred; providing that the benefit
shall be offset by whatever contributions had been
refunded to the member; providing that the provisions
of this Act apply to members who have transferred to
certain pension systems after a certain date; and
making this Act an emergency measure.
BY repealing and reenacting, with amendments,
Article 73B - Pensions
Section 117(5)(b) and (7)(b), 145(5)(b) and (7)(c)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article 73B - Pensions
117.
(5) (b) In no event shall a member receive a
disability allowance for a disability incurred prior to
enrollment in the pension system, except to the extent that
such a disability was aggravated subsequent to the member's
enrollment. A MEMBER WHO TRANSFERRED TRANSFERS FROM THE
EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF MARYLAND OR THE
TEACHERS' RETIREMENT SYSTEM OF THE STATE OF MARYLAND TO THE
PENSION SYSTEM FOR EMPLOYEES OF THE STATE OF MARYLAND SHALL
RETAIN THE ENROLLMENT DATE FIRST ESTABLISHED IN THE
RETIREMENT SYSTEM FROM WHICH THE MEMBER TRANSFERRED.
(C) ANY MEMBER APPLYING FOR DISABILITY
RETIREMENT WHO HAS TRANSFERRED FROM THE EMPLOYEES'
RETIREMENT SYSTEM OR THE TEACHERS' RETIREMENT SYSTEM TO THIS
PENSION SYSTEM WITHIN 2 YEARS OF THE FILING OF THE
