(House Bill 1767)

AN ACT concerning

St. Mary's County -
Office of Planning and Zoning

FOR the purpose of altering the name of the agency in St.
Mary's County that is responsible for reviewing certain
building permits and subdivision development proposals.

BY repealing and reenacting, with amendments,

The Public Local Laws of St. Mary's County
Section 227-1 and 227-2

Article 19 - Public Local Laws of Maryland
(1979 Edition, supplemented to December, 1980,
as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Code of Public Local Laws
of Maryland be repealed, amended, or enacted to read as
follows:

Article 19 - St. Mary's County

227-1.

The Office of [Land Use and Development] PLANNING AND
ZONING shall review all building permit applications for new
construction or substantial improvements to determine
whether proposed building sites will be reasonably safe from
flooding. If a proposed building site is in a location that
has a flood hazard, any proposed new construction or
substantial improvement, including prefabricated and mobile
homes, must:

A.  Be designed, or modified, and anchored to prevent
flotation, collapse or lateral movement of the structure.

B.  Use construction materials and utility equipment
that are resistant to flood damage.

C.  Use construction methods and practices that will
minimize flood damage.

227-2.

The Office of [Land Use and Development] PLANNING AND
ZONING and appropriate agencies shall review subdivision
proposals and other proposed new developments to assure
that:
