Ch. 23

(h) Each party state providing for the payment of
compensation and death benefits to injured members and the
representatives of deceased members of its National Guard
forces in case such members sustain injuries or are killed
within their own state, shall provide for the payment of
compensation and death benefits in the same manner and on
the same terms in case such members sustain injury or are
killed while rendering aid pursuant to this compact. Such
compensation and death benefits shall be deemed items of
expense reimbursable pursuant to paragraph (f) of this
article.

(i) In the event of any dispute between states as to
the property, amount of or items included in any claim of a
responding state, the governors of the requesting state and
such responding state, on the demand of either, shall submit
the same to arbitration by a panel of five persons
consisting of the commanding officer of the National Guard
forces of each such state, a person selected by each of said
governors and a fifth person designated by the attorneys
general of said states. In the event of the failure of said
attorneys general to agree on such fifth person, then a
person chosen by lot from among not more than three nominees
of each such attorney general shall serve. The panel shall
select its place or places of meeting and the timer thereof,
to conduct its proceedings in accordance with the rules of
the American Arbitration Association and have power or
subpoena. The cost and expenses of conducting such
arbitration and the fee, if any, of the arbitrators shall be
provided initially by the said states in equal shares
subject to the final award of the panel. The determination
of the panel shall be final and the amount of the award
shall be payable within 30 days thereafter.]

Article IV. Delegation

Nothing in this compact shall be construed to prevent
the governor of a party state from delegating any of his
responsibilities or authority respecting the National Guard,
provided that such delegation is otherwise in accordance
with law. For purposes of this compact, however, the
governor shall not delegate the power to request assistance
from another state.]

Article V. Limitations

Nothing in this compact shall:

(a) Expand or add to the functions of the National
Guard, except with respect to the jurisdictions within which
such functions may be performed.
