restricting or prohibiting the retail sale of any poison,
which said rules and regulations must be applicable to all
persons alike, and it shall be the duty of the said State
Department of Health, upon request, to furnish any person,
authorized by this subtitle to sell or dispense any poisons,
with a list of all articles, preparations and compounds, the
sale of which is prohibited or regulated by this subtitle.
(B) The powers and duties of the [Maryland] STATE
Board of Pharmacy with reference to notice and hearing under
the provisions of § 277 of this subtitle, shall be vested in
and imposed upon the State Department of Health with respect
to all orders, rules and regulations passed or promulgated
under the provisions of this section; and the provisions of
said § 277 relating to appeals to the Circuit Court of
Baltimore City or the Circuit Court No. 2 of Baltimore City
shall likewise be applicable to the orders, rules and
regulations passed under the provisions of this section.

Any person, copartnership, association or corporation
violating any of the provisions of this subtitle or any of
the rules or regulations passed by the [Maryland] STATE
Board of Pharmacy or the Maryland State Department of Health
pursuant to the provisions of this subtitle, shall, upon
conviction, be deemed guilty of a misdemeanor and fined not
more than one hundred ($100) dollars for each offense.

(a) Notwithstanding the provisions of any other section
of this article OR THE HEALTH OCCUPATIONS ARTICLE, students
in courses of study of cosmetology in the public schools of
the State, who have completed 1,000 hours of study in
cosmetology may accept employment in the duties of
apprentices under the direct supervision of licensed beauty
shop managers for a salary in privately owned beauty salons
in the State.

(1) This section may not prevent the Secretary from
exercising any of his powers conferred by THE HEALTH
OCCUPATIONS ARTICLE OR Article 43 of the Code.

(b) This subtitle shall not be construed to prevent
any person, who is a [medical or osteopathic] physician
licensed to practice by the STATE Board of Medical
Examiners, or is an audiologist holding a certificate of
clinical competence from the American Speech and Hearing
Association, from treating or fitting hearing aids to the
human ear.
