chemical preparation for medicinal use, recognized or
authorized by the latest edition of the United States
Pharmacopoeia AND NATIONAL FORMULARY, or prepared according
to the private formula of some individual or firm, other or
different from the prescription drug, controlled dangerous
substances, medicine, chemical or preparation, ordered or
called for by such person, or called for in a physician's or
other authorized prescribers' prescription, except as
authorized under [§ 273A of Article 43] § 12-508 OF THE
HEALTH OCCUPATIONS ARTICLE, shall be guilty of a
misdemeanor, and upon conviction thereof shall be punished
by a fine of not less than $100 nor more than $500, or by
not less than one month nor more than 12 months'
imprisonment, or by both, and any person so convicted shall
forfeit the right to practice pharmacy under any certificate
or registration issued under the laws of this State.

(e) The following departments, agencies, commissions,
boards and councils shall be included within the Department
of Health and Mental Hygiene: the State Department of
Health, the State Department of Mental Hygiene, the
Department of Postmortem Examiners, the State Department of
Juvenile Services, the State Board of Dental Examiners, the
Maryland Health Planning and Development Agency, the
Commission on Physical Fitness, the STATE Board of Medical
Examiners [for the State of Maryland], the Commission on
Medical Discipline of Maryland, the Anatomy Board of
Maryland, the [Maryland] STATE Board of Pharmacy, the State
Board of Examiners of Nurses, the State Board of [Funeral
Directors and Embalmers of Maryland] MORTICIANS, the STATE
Board of Examiners [of] IN Optometry [for the State of
Maryland], the STATE Board of Osteopathic Examiners [for the
State of Maryland], the STATE Board of Podiatry Examiners
[for the State of Maryland], the State Board of Chiropractic
Examiners, the Advisory Board on Hospital Licensing, the
Advisory Council on Hospital Construction, the State Board
of Physical Therapy Examiners, the State Board of Examiners
of Psychologists, the Radiation Control Advisory Board, the
Air Quality Control Advisory Council, the STATE Board of
Sanitarian Registration, the Maryland State Board of Well
Drillers, the Hazardous Substances Advisory Council, THE
STATE BOARD OF EXAMINERS FOR AUDIOLOGISTS, THE STATE BOARD
OF ELECTROLOGISTS, THE STATE BOARD OF EXAMINERS OF NURSING
HOME ADMINISTRATORS, THE STATE BOARD OF OCCUPATIONAL THERAPY
PRACTICE, THE STATE BOARD OF SOCIAL WORK EXAMINERS, THE
STATE BOARD OF EXAMINERS FOR SPEECH PATHOLOGISTS, and such
other departments, agencies, commissions, boards, councils
or units as may hereafter by law be deemed to be part of the
Department of Health and Mental Hygiene. The Secretary of
Health and Mental Hygiene shall have such authority and
powers over the departments and other units herein
