19-312. INVESTIGATIVE AND ENFORCEMENT POWERS OF THE BOARD.

(A)  INVESTIGATIVE POWERS.

(1)  THE BOARD SHALL INVESTIGATE ANY ALLEGED
VIOLATION OF THIS TITLE.

(2)  THE BOARD MAY ISSUE SUBPOENAS, ADMINISTER
OATHS, AND EXAMINE WITNESSES.

(B)  ENFORCEMENT POWERS.

(1)  THE BOARD MAY SUE TO ENFORCE ANY PROVISION
OF THIS TITLE BY INJUNCTION OR OTHER APPROPRIATE PROCEEDING.

(2)  AN ACTION UNDER THIS SUBSECTION IS IN
ADDITION TO AND NOT INSTEAD OF CRIMINAL PROSECUTION UNDER §
19-408 OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the last half of
Art. 43, § 804(1) and from Art. 43, § 806(b).

The reference to fees in present Art. 43, §
804(1) now appears in § 19-206 of this title.
The balance of present Art. 43, § 804(1) is
deleted as noted in the revisor's note to §
19-205 of this title.

19-313. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS
-- GROUNDS AVAILABLE.

SUBJECT TO THE HEARING PROVISIONS OF § 19-314 OF THIS
SUBTITLE, THE BOARD MAY DENY A LICENSE OR LIMITED LICENSE TO
ANY APPLICANT, REPRIMAND ANY LICENSEE OR HOLDER OF A LIMITED
LICENSE, OR SUSPEND OR REVOKE A LICENSE OR LIMITED LICENSE
IF THE APPLICANT, LICENSEE, OR HOLDER:

(1)  FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A LICENSE OR LIMITED LICENSE FOR THE
APPLICANT, LICENSEE, OR HOLDER OR FOR ANOTHER;

(2)  FRAUDULENTLY OR DECEPTIVELY USES A LICENSE
OR LIMITED LICENSE;

(3)  COMMITS FRAUD OR DECEIT IN THE PRACTICE OF
SPEECH PATHOLOGY;

(4)  IS CONVICTED OF A CRIME INVOLVING MORAL
TURPITUDE;

(5)  OBTAINS A FEE THROUGH FRAUD OR
MISREPRESENTATION;
