(1) APPLIES TO THE BOARD FOR REINSTATEMENT OF
THE LICENSE WITHIN 5 YEARS AFTER THE LICENSE EXPIRES;
(2) MEETS THE RENEWAL REQUIREMENTS OF § 19-308
OF THIS SUBTITLE; AND
(3) PAYS TO THE BOARD THE REINSTATEMENT FEE SET
BY THE BOARD.
(B) EXPIRED FOR MORE THAN 5 YEARS.
THE BOARD MAY NOT REINSTATE THE LICENSE OF A SPEECH
PATHOLOGIST WHO FAILS TO APPLY FOR REINSTATEMENT OF THE
LICENSE WITHIN 5 YEARS AFTER THE LICENSE EXPIRES. HOWEVER,
THE SPEECH PATHOLOGIST MAY BECOME LICENSED BY MEETING THE
CURRENT REQUIREMENTS FOR OBTAINING A NEW LICENSE UNDER THIS
SUBTITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last two
sentences of Art. 43, § 798(a) and from Art. 43,
§ 798(b).
As to subsection (a)(1) of this section, the
present reference to a license that was
"suspended for failure to renew" is deleted as
misleading. See the revisor's note to § 19-308
of this subtitle.
Subsection (a)(2) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article. It states expressly a provision that
presently is only implied in the law: i.e., that
a speech pathologist must comply with the renewal
requirements of this subtitle before the Board
may reinstate the expired license of the speech
pathologist.
As to subsection (a)(2) of this section, the
restriction on the Board against requiring a
speech pathologist who applies for reinstatement
within a 5-year period to take an examination, is
deleted as unnecessary in light of the reference
to the renewal requirements of § 19-308 of this
subtitle. See Kahn v. State Board of Examiners
of Optometry, 162 Md. 667 (1932), for possible
application as to the status and rights of a
former licensee who has failed to renew the
license and who then seeks reinstatement.
19-310. LIMITED LICENSE.
(A) AUTHORITY TO ISSUE.
SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
