REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
870(a)(1).

The reference to "attempt" to practice social
work is added to conform to similar provisions
governing other health occupations in present
Art. 43. See, e.g., Art. 43, § 489(a), as to
podiatrists.

As to exceptions, see §§ 18-103 and 18-301(b) of
this title.

Present Art. 43, § 870(a)(5), which prohibits the
use or attempted use of "an expired, revoked, or
nonexistent license", is deleted as superfluous.

18-402. MISREPRESENTATION.

UNLESS AUTHORIZED TO PRACTICE SOCIAL WORK UNDER THIS
TITLE, A PERSON MAY NOT:

(1)  REPRESENT TO THE PUBLIC THAT THE PERSON IS A
LICENSED SOCIAL WORKER; OR

(2)  USE ANY TITLE, ABBREVIATION, SIGN, CARD, OR
OTHER REPRESENTATION THAT THE PERSON IS A LICENSED SOCIAL
WORKER, INCLUDING THE USE OF THE WORDS "SOCIAL WORKER" OR
"SOCIAL WORK".

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §§
859(b) and 870(a)(6).

The introductory phrase of present Art. 43, §
859(b), which states the purpose of the specified
prohibition, is deleted as unnecessary and, in
any event, is covered by § 18-102 of this title.

Since the noncriminal provisions of present Art.
43, § 859(b) are only a more specific statement
of the prohibited act enumerated in present Art.
43, § 870(a)(6), the Commission to Revise the
Annotated Code has revised both provisions within
the prohibited acts of this section.

18-403. USING LICENSE OF ANOTHER INDIVIDUAL; IMPERSONATING
A LICENSED SOCIAL WORKER.

A PERSON MAY NOT INTENTIONALLY:

(1) USE OR ATTEMPT TO USE THE LICENSE OF ANOTHER
PERSON WHO IS A LICENSED SOCIAL WORKER; OR

(2) IMPERSONATE ANOTHER PERSON WHO IS A LICENSED
SOCIAL WORKER.
