(5) A MEMBER MAY NOT SERVE MORE THAN TWO
CONSECUTIVE FULL TERMS.
(G) REMOVAL.
THE GOVERNOR MAY REMOVE A MEMBER FOR INCOMPETENCE OR
MISCONDUCT.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
801(a), (b), (c), and (h) and the second sentence
of § 802(a) and from Art. 43, § 802(b)(1) through
(5).
Subsection (e) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to state the duty of an individual
appointed to any office of profit or trust to
take the oath specified in Art. I, § 9 of the
State Constitution.
Subsection (g) of this section is new language
derived without substantive change from Art. II,
§ 15 of the State Constitution. For other
provisions on removal, see: Art. XV, § 2 of the
State Constitution, on suspension and removal for
crimes; and Art. 41, § 4 of the Code, on removal
for failure to attend meetings.
In subsection (a)(2) of this section, the
ambiguous requirement of present Art. 43, §
801(a)(1) that all audiologist and speech
pathologist members of the Board hold "valid
licenses" is revised to require that the
audiologist members be licensed to practice
audiology and the speech pathologist member be
licensed to practice speech pathology. This
revision conforms with current Board practice and
with the apparent intent of the General Assembly.
In subsection (a)(3), (4), and (5) of this
section, as to the substitution of the phrase
"with the advice of the Secretary" for "on the
recommendation of the Secretary", see the General
Revisor's Note to this article.
In subsection (a)(3) of this section, the term
"Maryland Society of Otolaryngology" is
substituted for the term "Maryland Ear, Nose and
Throat Society" to conform to the current name of
the organization.
As to the continuing stagger under subsection
(f)(2) of this section, the terms of the members
serving on July 1, 1981 expire as follows: (1)
one member in 1981; (2) two members in 1982; (3)
