EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, THE
APPLICANT SHALL PASS AN EXAMINATION GIVEN BY THE BOARD UNDER
THIS SUBTITLE.
(F) EXPERIENCE.
THE APPLICANT SHALL HAVE AT LEAST 2 YEARS OF
PROFESSIONAL EXPERIENCE IN PSYCHOLOGY.
(G) RESIDENCE; PLACE OF PRACTICE.
(1) EXCEPT AS PROVIDED IN THIS SUBSECTION, AN
APPLICANT SHALL RESIDE OR PRACTICE, OR INTEND TO RESIDE OR
PRACTICE, IN THIS STATE.
(2) THE BOARD MAY CERTIFY AN APPLICANT WHO IS
NEITHER A RESIDENT OF THIS STATE NOR PRACTICING IN THIS
STATE IF THE APPLICANT SHOWS THAT THE CERTIFICATION WOULD BE
IN THE PUBLIC INTEREST OF THE CITIZENS OR GOVERNMENT OF THIS
STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second clause
of the second sentence of Art. 43, § 629, from
Art. 43, § 629(1) through (5), and from Art. 43,
§ 642.
In subsection (g) of this section, the reference
to intent to reside or practice in this State is
new language added for clarity and to conform to
the actual practice of the Board.
Present Art. 43, § 629(3), which requires that an
applicant be a citizen of the United States or
have legally declared the intent to become a
citizen of the United States, is deleted as
unconstitutional because it creates a suspect
classification that does not withstand the close
judicial scrutiny required by the Equal
Protection Clause of the 14th Amendment of the
U.S. Constitution. See Examining Board of
Engineers, Architects, and Surveyors v. Flores De
Otero, 426 U.S. 572 (1976); and In re Griffiths,
413 U.S. 717 (1973).
Present Art. 43, § 631(1) through (4), which
provides for waiver of examination or educational
requirements for certain individuals during the
periods ending December 31, 1957 and December 31,
1959, is deleted as obsolete.
16-303. APPLICATIONS FOR CERTIFICATION.
TO APPLY FOR CERTIFICATION, AN APPLICANT SHALL:
(1) SUBMIT A VERIFIED APPLICATION TO THE BOARD
ON THE FORM THAT THE BOARD REQUIRES; AND
