(24) PERFORMS AN ABORTION OUTSIDE A LICENSED
HOSPITAL.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last clause
of the first sentence of Art. 43, § 130(b) and
from Art. 43, § 130(h).
Also in the introductory language of this
section, the present provision requiring "six
votes" for suspension or revocation is restated,
without substantive change, in more general
language. The new language conforms to similar
provisions in other titles of this article and
will accommodate possible future legislative
changes in the number of members to be appointed
to the Commission, without the necessity of
enacting a conforming change here. As to the
current "full authorized membership" of the
Commission, see § 14-402(a)(1) of this title.
Also as to the introductory language to this
section, the present statement that the
Commission may "dismiss the charges" is deleted
as unnecessary. See also § 14-506(b) of this
subtitle.
Items (1) and (2) of this section, which are
derived from present Art. 43, § 130(h)(1), are
rephrased in standard language used in similar
provisions governing other health occupations in
present Art. 43. They state fundamental grounds
for disciplining a licensee. For an example of a
similar provision in the present law, see
present Art. 43, § 266A(c)(1)(iii), as to
pharmacists.
In item (6) of this section, the reference to
proceeding even if an appeal or other proceeding
to have the conviction or plea set aside is
pending is added to clarify that once there is a
court conviction the Board may act.
In item (9) of this section, the present phrase
"illegal use of" is deleted as misleading. Any
addiction to a controlled dangerous substance is
grounds for action under this section.
In item (19) of this section, the present
exception as to a person "in an accredited
preceptorship or residency training program" is
deleted as unnecessary because the practice of
medicine by such a person is not "unauthorized".
In item (22) of this section, the phrase "grounds
for disciplinary action" is substituted for the
