(5)  MAY NOT HAVE A HOUSEHOLD MEMBER WHO
PARTICIPATES IN A COMMERCIAL OR PROFESSIONAL FIELD RELATED
TO MEDICINE; AND

(6)  MAY NOT HAVE HAD WITHIN 2 YEARS BEFORE
APPOINTMENT A SUBSTANTIAL FINANCIAL INTEREST IN A PERSON
REGULATED BY THE COMMISSION.

(C)  SAME — RESTRICTION.

WHILE A MEMBER OF THE COMMISSION, A CONSUMER MEMBER MAY
NOT HAVE A SUBSTANTIAL FINANCIAL INTEREST IN A PERSON
REGULATED BY THE COMMISSION.

(D)  SERVICE IN DUAL CAPACITIES PROHIBITED.

(1)  AN INDIVIDUAL MAY NOT SERVE AS A MEMBER OF
THE COMMISSION IN A DUAL CAPACITY.

(2)  TO AVOID SERVICE BY AN INDIVIDUAL IN A DUAL
CAPACITY, THE SECRETARY MAY APPOINT A PRACTICING LICENSED
PHYSICIAN FROM A LIST OF NOMINEES SUBMITTED BY THE FACULTY
IN ACCORDANCE WITH SUBSECTION (A)(3) OF THIS SECTION.

(E)  OATH.

BEFORE TAKING OFFICE, EACH EX OFFICIO MEMBER AND
APPOINTEE TO THE BOARD COMMISSION SHALL TAKE THE OATH
REQUIRED BY ARTICLE I, § 9 OF THE STATE CONSTITUTION.

(F)  TENURE; VACANCIES.

(1)  THE TERM OF A EACH APPOINTED MEMBER IS 3
YEARS, EXCEPT THAT THE INITIAL TERM OF ONE OF THE CONSUMER
MEMBERS IS 2 YEARS.

(2)  THE TERMS OF THE APPOINTED MEMBERS ARE
STAGGERED AS REQUIRED BY THE TERMS PROVIDED FOR MEMBERS OF
THE COMMISSION ON JULY 1, 1981.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(G)  REMOVAL OF MEMBER.

A MEMBER OF THE COMMISSION MAY BE REMOVED BY THE
SECRETARY FOR NEGLECT OF DUTY, MISCONDUCT, MALFEASANCE, OR
MISFEASANCE IN OFFICE.
