that had been listed as "unprofessional conduct"
and the other listed grounds for action against a
licensed pharmacist; see § 12-311 of this title.
In order to give present Art. 43, § 268(b)(g)
effect, and in conformity with the intent of the
General Assembly to eliminate any distinction in
the types of grounds listed in present Art. 43, §
266A, the Commission to Revise the Annotated Code
has revised present Art. 43, § 268(b)(g) in a
manner that provides a mechanism for holding a
pharmacy responsible if it participates in any
activity that is a ground for action against a
licensed pharmacist under § 12-311 of this title.
This revision is called to the attention of the
General Assembly.
12-404. APPLICATION FOR PHARMACY PERMITS.
(A) IN GENERAL.
TO APPLY FOR A PHARMACY PERMIT, AN APPLICANT SHALL:
(1) SUBMIT AN APPLICATION TO THE BOARD ON THE
FORM THAT THE BOARD REQUIRES; AND
(2) PAY TO THE BOARD AN APPLICATION FEE OF $40.
(B) SEPARATE APPLICATIONS REQUIRED.
FOR EACH PHARMACY PERMIT FOR WHICH A PERSON APPLIES,
THE PERSON SHALL SUBMIT A SEPARATE APPLICATION AND PAY A
SEPARATE APPLICATION FEE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence and — as it applies to separate
applications — the fourth sentence of Art. 43, §
268(a).
12-405. ISSUANCE OF PHARMACY PERMIT; NOTICE OF DENIAL.
(A) ISSUANCE.
THE BOARD SHALL ISSUE A PHARMACY PERMIT TO ANY
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS TITLE.
(B) NOTICE OF DENIAL.
IF THE BOARD DENIES A PHARMACY PERMIT TO AN APPLICANT,
IT SHALL GIVE THE APPLICANT WRITTEN NOTICE OF ITS DECISION
AND THE REASONS FOR THE DENIAL.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived in part from Art. 43, §
268(b)(c), which indicates that a pharmacy permit
"shall be issued" to persons who meet the
