the standard form used throughout this article to
state term and renewal provisions.

Subsection (b) of this section — which provides
for renewal notice — is new language added to
conform to current Board practice and to similar
provisions governing other health occupations in
present Art. 43. See, e.g., Art. 43, § 634(c),
as to psychologists, and Art. 43, § 868(d), as to
social workers.

Subsection (a) of this section is revised to
state expressly a provision that presently is
only implied in Art. 43, § 266C; i.e., that a
license issued under this title has a specific
term, which "expires" at a specific time. The
reference to "an even-numbered year" is
substituted for the present reference to "every
two years" to conform to Board practice and to
indicate clearly that all licenses expire on the
same date, regardless of the date of issuance.

12-309. REINSTATEMENT OF EXPIRED LICENSES.

THE BOARD SHALL REINSTATE THE LICENSE OF A PHARMACIST
WHO HAS FAILED TO RENEW THE LICENSE FOR ANY REASON, IF THE
PHARMACIST:

(1)  MEETS THE RENEWAL REQUIREMENTS OF § 12-308
OF THIS SUBTITLE; AND

(2)  PAYS TO THE BOARD, IN ADDITION TO THE
RENEWAL FEE REQUIRED UNDER § 12-308 OF THIS SUBTITLE, A
REINSTATEMENT FEE OF $2 FOR EACH TERM THAT THE PHARMACIST
HAS FAILED TO SUBMIT A RENEWAL APPLICATION AND FEE WITHIN
THE TIME REQUIRED BY THE BOARD.

REVISOR'S NOTE: This section is new language derived in
part from the second sentence of Art. 43, § 266C.

The section is revised for clarity and to reflect
the actual practice of the Board and the apparent
intent of the present law; it clarifies, for
example, that mere failure to renew does not
require the former licensee to take again the
examination required for new applicants.

See Kahn v. State Board of Examiners of
Optometry, 162 Md. 667 (1932) for possible
application to the status and rights of a former
licensee who has failed to renew the license and
who then seeks reinstatement.

12-310. DISPLAY OF LICENSES.

EACH LICENSEE SHALL DISPLAY THE LICENSE CONSPICUOUSLY
IN THE OFFICE OR PLACE OF BUSINESS OF THE LICENSEE.
