AN AGREEMENT MAY BE MADE WITH ANOTHER STATE UNDER THIS
SECTION ONLY IF, UNDER THE AGREEMENT, THE OTHER STATE WAIVES
THE EXAMINATION OF LICENSEES OF THIS STATE TO A SIMILAR
EXTENT AS THIS STATE WAIVES THE EXAMINATION REQUIREMENTS FOR
INDIVIDUALS LICENSED IN THAT STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first
paragraph of Art. 43, § 266. Its revision is
patterned after the standard language used
throughout this article for provisions that allow
reciprocal agreements for the waiver of
examination requirements.
In subsection (b)(3)(ii) of this section, the
phrase "or any other state" is added to provide
expressly that a pharmacist who passed a
licensing examination in one state, and who then
was waived into a second state, then may be
waived by the Board into Maryland — a third
state — on the basis of the license in the
second state, which was acquired by waiver on the
basis of being examined and licensed in the first
state. This provision, which is included in most
of the titles of this article and which conforms
with Board practice, allows the Board to give
fair consideration under this section to a
pharmacist who, in the course of the pharmacist's
professional career, has moved from one state to
another before moving to Maryland to practice
here.
The second paragraph of Art. 43, § 266, which
provides that this section does not apply to
assistant pharmacists licensed under present Art.
43, § 262, is deleted as obsolete. There are no
longer any individuals who practice or who may
qualify to practice as assistant pharmacists in
this State.
12-306. ISSUANCE OF LICENSE.
THE BOARD SHALL ISSUE A LICENSE TO ANY APPLICANT WHO
MEETS THE REQUIREMENTS OF THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the language in
the first sentence of Art. 43, § 261(a) that
provides that a qualified applicant "shall be
registered ... and be given a certificate of such
registration". It is revised in the standard
language used in corresponding sections of other
titles of this article.
