remedy or ingredient for a spraying solution, in
bulk or otherwise". After conferring with many
administrative consultants, the Commission has
been unable to determine the meaning of this
rather ambiguous provision. Since this title
does not otherwise purport to regulate the sale
of any farm remedy or ingredient for a spraying
solution, it appears that subsection (c)(3) is an
archaic provision that has no practical
application.

Present Art. 43, § 267, which concerns the
application of this title in Talbot County, is
deleted as obsolete and, in any event,
unnecessary in light of Ch. 571, Acts of 1906.

SUBTITLE 2. STATE BOARD OF PHARMACY.

12-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF PHARMACY IN THE DEPARTMENT.

REVISOR'S NOTE: This section presently appears as Art.
43, § 257(a).

It is set forth as a separate section for
emphasis.

The word "State" is substituted for "Maryland" in
the Board title to correspond with other health
occupation board designations used in this
article.

The only other changes are in style.

12-202. MEMBERSHIP.

(A) COMPOSITION.

(1)  THE BOARD CONSISTS OF EIGHT MEMBERS.

(2)  OF THE EIGHT BOARD MEMBERS:

(I)  SIX SHALL BE LICENSED PHARMACISTS, OF
WHOM AT LEAST FIVE ARE ACTIVELY ENGAGED IN PRACTICING
PHARMACY; AND

(II)  TWO SHALL BE CONSUMER MEMBERS.

(3)  THE GOVERNOR SHALL APPOINT THE PHARMACIST
MEMBERS, WITH THE ADVICE OF THE SECRETARY, FROM A LIST OF
NAMES SUBMITTED TO THE SECRETARY AND THE GOVERNOR BY THE
MARYLAND PHARMACEUTICAL ASSOCIATION. THE NUMBER OF NAMES ON
THE LIST SHALL BE THREE TIMES THE NUMBER OF VACANCIES.

(4)  THE GOVERNOR SHALL APPOINT THE CONSUMER
MEMBERS WITH THE ADVICE OF THE SECRETARY AND THE ADVICE AND
CONSENT OF THE SENATE.
