prohibits practicing medicine without a license,
and § 10-101(f) of this title, which defines
"practice optometry".

SUBTITLE 5. PROHIBITED ACTS; PENALTIES.

10-501. PRACTICING WITHOUT LICENSE.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A PERSON
MAY NOT PRACTICE, ATTEMPT TO PRACTICE, OR OFFER TO PRACTICE
OPTOMETRY IN THIS STATE UNLESS LICENSED BY THE BOARD.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
372(a) — except the reference in that subsection
to the use of the title "optometrist", which now
appears in § 10-502 of this title.

The reference to an "attempt" or "offer" to
practice is added to conform to similar
provisions governing other health occupations in
present Art. 43. See, e.g., Art. 43, § 489(a),
as to podiatrists, and Art. 43, § 768, as to
nursing home administrators.

As to the referenced exceptions, see §§ 10-102
and 10-301 of this title.

10-502. MISREPRESENTATION AS OPTOMETRIST.

-UNLESS LICENSED TO PRACTICE OPTOMETRY UNDER THIS TITLE,
A PERSON MAY NOT REPRESENT TO THE PUBLIC BY TITLE, BY
DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR
OTHERWISE, THAT THE PERSON PRACTICES OPTOMETRY.

REVISOR'S NOTE: This section is derived in part from
Art. 43, § 372(a), as that subsection relates to
use of the title "optometrist", and restated in
the standard language used throughout this
article to express a prohibition against false
representations of authority to practice a health
occupation.

10-505. PENALTIES.

A PERSON WHO VIOLATES ANY PROVISION OF THIS TITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 6
MONTHS OR BOTH.
