Ch.8

(1)  PAYS THE APPLICATION FEE SET BY THE BOARD
UNDER § 9-304 OF THIS SUBTITLE; AND

(2)  PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:

(I)  MEETS THE QUALIFICATIONS OTHERWISE
REQUIRED BY THIS TITLE; AND

(II)  BECAME LICENSED IN THE OTHER STATE
AFTER MEETING REQUIREMENTS IN THAT OR ANY OTHER STATE THAT
ARE AT LEAST EQUIVALENT TO THE REQUIREMENTS OF THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
923(b)(2). Its revision is patterned after the
standard language used throughout this article
for provisions that allow or require waiver of
examination requirements.

In subsection (a) of this section, "any other
state" is substituted for "another state or
territory of the United States" in light of the
definition of "state" in § 1-101 of this article.

Also in subsection (a) of this section, the
phrase "or its equivalent" is new language added
to avoid confusion where another state describes
"limited occupational therapy" using different
words.

In subsection (b)(2)(ii) of this section, the
phrase "or any other" state is added to provide
expressly that an occupational therapist or an
occupational therapy assistant who met the
licensing requirements in one state, and who then
was waived into a second state, then may be
waived by the Board into Maryland — a third
state — on the basis of the license in the
second state, which was acquired by waiver on the
basis of the licensing requirements in the first
state. This provision, which is patterned after
comparable sections in other titles of this
article, allows the Board to give fair
consideration under this section to an
occupational therapist or an occupational therapy
assistant who, in the course of that professional
career, has moved from one state to another
before moving to Maryland to practice here.

9-307. SAME — NATIONALLY CERTIFIED APPLICANTS.

(A) MANDATORY WAIVER.

SUBJECT TO THE PROVISIONS OF THIS SUBSECTION, THE BOARD
SHALL WAIVE THE APPROPRIATE EXAMINATION REQUIREMENT OF THIS
TITLE FOR AN APPLICANT WHO:
