REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 916.

As to subsection (c) of this section, Standard
State Travel Regulations are adopted by the
Department of Personnel with the approval of the
Board of Public Works.

9-205. MISCELLANEOUS POWERS AND DUTIES.

(A)  POWERS.

IN ADDITION TO THE POWERS SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD MAY ADOPT:

(1)  RULES AND REGULATIONS TO CARRY OUT THE
PROVISIONS OF THIS TITLE; AND

(2)  A CODE OF ETHICS FOR LICENSEES.

(B)  DUTIES.

IN ADDITION TO THE DUTIES SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD SHALL KEEP:

(1)  RECORDS AND MINUTES NECESSARY FOR THE
ORDERLY CONDUCT OF BUSINESS; AND

(2)  A LIST OF EACH CURRENTLY LICENSED
OCCUPATIONAL THERAPIST AND OCCUPATIONAL THERAPY ASSISTANT.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
917(a), (b), and (d).

The powers and duties of the Board are listed
separately in subsections (a) and (b) of this
section to clarify when the Board acts in a
mandatory or discretionary capacity. This
division into separate powers and duties is
called to the attention of the General Assembly.

Subsection (a)(2) of this section is new language
added to conform to the provision in present Art.
43, § 930(a)(4) — now § 9-314(5) of this title
— which provides for disciplinary action if a
provision of the code of ethics is violated.

Present Art. 43, § 917(c), which elaborates on
the administrative and enforcement powers, is
deleted as unnecessary in light of the general
powers of the Board in this section and the
broader licensing and examination powers of the
Board in §§ 9-301 and 9-305, respectively, of
this title.
