In subsection (a)(3) and (4) of this section, as
to the substitution of the phrase "with the
advice of the Secretary" for "on the
recommendation of the Secretary", see the General
Revisor's Note to this article.
Also in subsection (a)(3) of this section, new
language is added to clarify that the Maryland
Occupational Therapy Association sends a list of
names to both the Governor and the Secretary.
In subsection (b) of this section, the phrase
"practicing ... limited occupational therapy" is
added as an alternative qualifying experience to
allow the occupational therapy assistant member
to have only practiced limited occupational
therapy.
In subsection (c)(5) of this section,
"participates" is substituted for "participated"
to conform to the uniform approach inherent in
Ch. 702, Acts of 1980, which enacted the
provisions concerning consumer representatives on
the health occupations boards governed by this
article. Also, the Department advised that the
uniform approach was intended and that the
deviation "participated" was a technical error.
Present Art. 43, §§ 803(b)(5)(iii) and
914(a)(2)(iii)3. contain the only 2 references
out of 19 in Ch. 702, Acts of 1980, to a consumer
member who does not have a household member who
"participated" in a field related to speech
pathology or occupational therapy, respectively.
The Commission to Revise the Annotated Code calls
this substitution to the attention of the General
Assembly.

As to subsection (g) of this section, for other
provisions on removal, see: Art. II, § 15 of the
State Constitution, on removal for incompetency
or misconduct; Art. XV, § 2 of the State
Constitution, on suspension and removal for
crimes; and Art. 41, § 4 of the Code, on removal
for failure to attend meetings.
The last sentence of present Art. 43, § 914(c),
which requires each member who is an occupational
therapist or an occupational therapy assistant at
all times to hold a valid license, is deleted as
redundant in light of subsection (a)(2)(i) and
(ii) of this section.
