(A) IN GENERAL.
UNLESS AUTHORIZED TO PRACTICE AS A NURSING HOME
ADMINISTRATOR UNDER THIS TITLE, A PERSON MAY NOT REPRESENT
TO THE PUBLIC BY TITLE, BY DESCRIPTION OF SERVICES, METHODS,
OR PROCEDURES, OR OTHERWISE, THAT THE PERSON IS AUTHORIZED
TO PRACTICE AS A NURSING HOME ADMINISTRATOR IN THIS STATE.
(B) CERTAIN REPRESENTATIONS PROHIBITED.
UNLESS AUTHORIZED TO PRACTICE UNDER THIS TITLE, A
PERSON MAY NOT USE THE TITLE "NURSING HOME ADMINISTRATOR",
OR THE ABBREVIATION "N.H.A." OR ANY OTHER DESIGNATION,
TITLE, OR ABBREVIATION WITH THE INTENT TO REPRESENT THAT THE
PERSON IS AUTHORIZED TO PRACTICE AS A NURSING HOME
ADMINISTRATOR.
REVISOR'S NOTE: This section is new language derived in
part from the second sentence of Art. 43, § 768,
as that sentence applies to misrepresentation, §
774(e), and § 776(a)(3), as that item applies to
misrepresentation. It is stated in the standard
language used throughout this article to express
a prohibition against false representation of
authority to practice a health occupation.
Subsection (b) of this section is derived from
those specific elements of Art. 43, § 774(e) that
are not covered clearly by the general language
of subsection (a) of this section.
The provisions of present Art. 43, §§ 768 and
776(a)(3) that prohibit practice as a nursing
home administrator without a license now appear
in § 8-401 of this subtitle.
The present references to an individual being
licensed and "registered" to practice are deleted
to conform with changes in terminology made
throughout this title. See the General Revisor's
Note to this title.
8-403. LICENSE FRAUD.
A PERSON MAY NOT:
(1) SELL OR FRAUDULENTLY OBTAIN OR FURNISH OR
AID IN SELLING OR FRAUDULENTLY OBTAINING OR FURNISHING A
LICENSE ISSUED UNDER THIS TITLE; OR
(2) PRACTICE AS A NURSING HOME ADMINISTRATOR
UNDER ANY LICENSE UNLAWFULLY OR FRAUDULENTLY OBTAINED OR
UNLAWFULLY ISSUED.

without substantive change from Art. 43, §
776(a)(1) and (2).
