5-202.

(d) (1) (i) Except as otherwise provided in this
subsection, "eligible [position] POSITION" means a position
that is held by an employee of the [local] COUNTY board [of
education] or local school system who is a member or who is
eligible to be a member of the Teachers' Retirement System
and:

1.  Who performs instructional duties
in a public day school during the normal 10-month school
year as a supervisory teacher, a teacher who is
certificated, a helping teacher, a classroom teacher aide;
or

2.  Who holds any other position in a
class that was considered eligible for State payment of
employer contributions for social security under the
standards applied by the Department of Personnel as of
January 11, 1980.

8-412.

(a)  If the enrollment and transportation are approved
by the State Superintendent, each county board shall provide
or arrange for the transportation during the regular school
year of each handicapped child in [a]:

(1)  [Public] A PUBLIC school;

(2)   [School] A SCHOOL maintained by a State
agency; and

(3)  A nonpublic school that is approved as a
special education facility by the Department.

17-103.

(b)  To qualify for State aid under this subtitle, an
institution of higher education shall:

(1)  Be a nonprofit private college or university
that was established in this State before July 1, 1970;

(2)  Be accredited by the State Board [of] FOR
Higher Education;

(3)  Maintain one or more earned degree programs,
other than seminarian or theological programs, leading to an
associate of arts or baccalaureate degree; and

(4)  Submit each new program and each major
modification of an existing program to the State Board for
Higher Education for its review and recommendation as to the
initiation of the new or modified program.
