supportive personnel. The effectiveness of the
individualized plan of [care] HABILITATION shall be
reevaluated periodically.
(b) The Director of Mental Retardation is responsible
for providing all necessary professional and support
personnel and equipment for full implementation of these
plans and shall issue appropriate directives to carry out
the intent of this section.
[(c) The Superintendent or Director of the State
residential facility and one other professional person of
the facility carrying major program responsibility who did
not participate in the development of the individualized
plans of care shall review and either approve, modify, or
disapprove each individualized plan of care as written.]
[(d)] (C) The plan approval shall be based on current
needs of the [clients] INDIVIDUAL.
SECTION 2. AND BE IT FURTHER ENACTED, That Section(s)
3(1) through (v), respectively, of Article 59A - Mental
Retardation, of the Annotated Code of Maryland be renumbered
to be Section(s) 3(m) through (w), respectively.
SECTION 3. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

As used in this article, the following terms shall have
the meanings indicated unless a contrary meaning is clearly
intended from the context in which the term appears:
(L) "HABILITATION" MEANS THAT DEGREE AND TYPE OF
EDUCATION, TRAINING, AND CARE REQUIRED BY THE RETARDED
INDIVIDUAL TO REACH HIS OR HER MAXIMUM DEVELOPMENT.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
