"NURSING HOME ADMINISTRATOR" MEANS AN INDIVIDUAL WHO
ADMINISTERS, MANAGES, OR IS IN GENERAL ADMINISTRATIVE CHARGE
OF A NURSING HOME WHETHER OR NOT THE INDIVIDUAL:

(1)  HAS AN OWNERSHIP INTEREST IN THE NURSING
HOME; OR

(2)  SHARES DUTIES AND FUNCTIONS WITH OTHER
INDIVIDUALS.

REVISOR'S NOTE: This subsection presently appears as
Art. 43, § 767(2).

The present reference to one who "supervises" a
nursing home is deleted as redundant of the other
descriptive verbs used.

The only other changes are in style.

REVISOR'S NOTE TO SECTION: Present Art. 43, § 767(4),
(5), and (6), which defines "person", "financial
interest", and "household member", is deleted as
unnecessary in light of the definitions of
"household member", "person", and "substantial
financial interest", in § 1-101 of this article.

8-102. SCOPE OF TITLE.

THIS TITLE DOES NOT LIMIT THE RIGHT OF AN INDIVIDUAL TO
PRACTICE A HEALTH OCCUPATION THAT THE INDIVIDUAL IS
AUTHORIZED TO PRACTICE UNDER THIS ARTICLE. "

REVISOR'S NOTE: This section is new language added to
reflect more accurately the state of the present
law and to conform to the language used in
similar provisions in other titles of this
article.

SUBTITLE 2. STATE BOARD OF EXAMINERS OF NURSING HOME
ADMINISTRATORS.

8-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF EXAMINERS OF NURSING HOME
ADMINISTRATORS IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of the first sentence and the first clause of the
second sentence of Art. 43, § 769(a).

It is set forth as a separate section for
emphasis.

The word "Maryland" is deleted from the Board
title to avoid the use of the duplicative terms
"Maryland" and "State" and to correspond with
